Terms of Service

By placing an order with Blues Custom Designs ("we," "us," or "our"), you ("the Client") agree to the following terms and conditions. Please read them carefully before submitting any order.

1. Right to Refuse Service

Blues Custom Designs reserves the absolute and unconditional right to refuse, decline, or cancel any order or commission request at any time, for any reason, with or without explanation. This includes, but is not limited to:

  • Requests that violate our creative guidelines or ethical standards
  • Clients with a history of disputes, chargebacks, or problematic behavior
  • Orders that we deem inappropriate, offensive, or outside our scope of expertise
  • Requests that conflict with our current workload or availability
  • Any other reason at our sole discretion

2. Payment Terms

All payments are required in full prior to the commencement of any work. No work will begin until payment has been received and confirmed. We do not offer payment plans, installments, or deferred payment options unless explicitly agreed upon in writing.

Accepted payment methods include: PayPal, Gift Cards (US only), Apple Pay, Cryptocurrency, Zelle, and Roblox Robux (very rare cases, at designer's discretion). We reserve the right to decline any payment method at our discretion.

No free commissions, samples, or "test work" will be provided under any circumstances. All services rendered are paid services only.

3. Pricing and Estimates

All prices listed on our website, promotional materials, or provided in quotes are estimates only and are subject to change based on:

  • Complexity of the requested design or service
  • Number of revisions requested
  • Urgency or rush delivery requirements
  • Additional features or customizations beyond the initial scope
  • Market conditions and material costs

Final pricing will be communicated and agreed upon before work begins. By proceeding with an order after receiving a final quote, you accept the stated price.

4. Revisions and Modifications

Unless otherwise specified, each commission includes a reasonable number of minor revisions. Major changes to the scope, concept, or direction of a project after work has begun may incur additional charges.

"Reasonable revisions" are defined at our sole discretion and typically include small adjustments to colors, text, or positioning—not complete redesigns or fundamental changes to the agreed-upon concept.

5. Satisfaction and Liability

We strive to deliver high-quality work that meets your specifications. However, satisfaction is subjective, and we cannot guarantee that you will be pleased with the final result.

Blues Custom Designs shall not be held liable for:

  • Dissatisfaction with the final product based on personal taste or preference
  • Changes in your vision or requirements after work has been completed
  • Issues arising from unclear, incomplete, or inaccurate information provided by the Client
  • Any indirect, incidental, consequential, or punitive damages arising from our services
  • Technical issues, bugs, or compatibility problems with third-party platforms (including but not limited to Roblox, Discord, etc.)

By placing an order, you acknowledge and accept that all sales are final and that creative work involves inherent subjectivity.

6. Refund Policy

All sales are final. No refunds will be issued once work has commenced, except at our sole discretion in extraordinary circumstances. Refund requests will be evaluated on a case-by-case basis.

Chargebacks, payment disputes, or fraudulent claims will result in immediate termination of services, blacklisting from future orders, and may result in legal action to recover losses.

7. Delivery and Timelines

Estimated delivery times are provided in good faith but are not guaranteed. Delays may occur due to:

  • High volume of orders
  • Complexity of the project
  • Waiting for Client feedback or approval
  • Technical difficulties or unforeseen circumstances

We are not liable for any damages, losses, or inconveniences caused by delays in delivery.

8. Intellectual Property and Usage Rights

Upon full payment, the Client receives a non-exclusive license to use the commissioned work for personal or commercial purposes as agreed. Blues Custom Designs retains the right to:

  • Display completed work in our portfolio, website, and promotional materials
  • Use work samples for marketing and demonstration purposes
  • Retain original source files unless otherwise agreed

Resale, redistribution, or claiming authorship of our work is prohibited unless explicitly authorized in writing.

9. Client Responsibilities

The Client agrees to:

  • Provide accurate, complete, and timely information necessary for the completion of the order
  • Respond to communications and revision requests in a timely manner
  • Ensure that all materials provided do not infringe on third-party intellectual property rights
  • Not use our services for illegal, fraudulent, or harmful purposes
  • Treat our team with respect and professionalism

10. Limitation of Liability

To the maximum extent permitted by law, Blues Custom Designs' total liability for any claims arising from or related to our services shall not exceed the amount paid by the Client for the specific order in question.

In no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill.

11. Indemnification

The Client agrees to indemnify, defend, and hold harmless Blues Custom Designs and its owners, operators, and affiliates from any claims, damages, losses, liabilities, and expenses (including attorney fees) arising from the Client's use of our services, violation of these terms, or infringement of any third-party rights.

12. Modifications to Terms

We reserve the right to modify, update, or change these Terms of Service at any time without prior notice. Continued use of our services after any changes constitutes acceptance of the revised terms. It is your responsibility to review these terms periodically.

13. Severability

If any provision of these Terms of Service is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

14. Entire Agreement

These Terms of Service constitute the entire agreement between the Client and Blues Custom Designs regarding the subject matter herein and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.
